This agreement (“Agreement”) is entered into on this 1st day of April, 2019, (the “Effective Date”) between Promise Network Inc., a Delaware corporation with offices at 436 14th Street, Suite 920, Oakland, CA 94612 (“Promise”), and the Customer listed above (“Customer”). This Agreement includes and incorporates the above Order Form, terms contained in web pages incorporated herein by reference, as well as the accompanying Terms and Conditions and contains, among other things, warranty disclaimers, liability limitations and use limitations. There will be no force or effect to any different terms of any related purchase order or similar form even if signed by the parties after the date hereof (unless specifically referencing this Agreement). Each party’s acceptance of this Agreement was and is expressly conditional upon the other’s acceptance of the terms contained in the Agreement to the exclusion of all other terms.
