This Public Drainage System Protection Agreement (the “Drainage Agreement”) is entered into by and between Freeborn Wind Energy LLC, a Delaware limited liability company (“Developer”) and Freeborn County, Minnesota (“County”), as a part of that certain Development Agreement entered into by the Parties on 1st of April, 2019 (the “Development Agreement”). Capitalized terms not otherwise defined herein shall have the meaning given them in the Development Agreement.
