MEMORANDUMRecapture Agreement • September 12th, 2018
In June 1999, the City and Roger Lautz Custom Homes entered into a Recapture Agreement pursuant to City Code allowing for the recapture of certain public improvements that were constructed by Mr. Lautz. Those public improvements were determined to benefit an adjacent property (Diagram 1, outlined in red - 1421 Gables Blvd, “Benefiting Property”). The cost of the benefiting improvements was determined to be $85,158.81. The improvements completed were a public road (Penny Lane), sidewalk, storm, water and sanitary sewer mains.
