The Cities of Burbank, a Municipal Corporation (hereinafter referred to as "BURBANK") and Glendale, a Municipal Corporation (hereinafter referred to as "GLENDALE"), (hereinafter also referred to as “Party” or collectively as the “Parties”), do hereby agree to establish this Recycled Water Exchange Agreement (“Agreement”), to provide for the delivery and exchange of locally treated surplus recycled water between the Parties, subject to the following provisions.

THIS AGREEMENT is made and entered into by and between the City of Los Angeles, hereinafter called “Los Angeles”, acting through its Department of Water and Power, hereinafter called “LADWP” and the City of Burbank, hereinafter called “Burbank” (both LADWP and Burbank being hereinafter referred to as “Party” or “Parties”).
