This statement is agreed on 18 May 2016 between NHS South Devon and Torbay Clinical Commissioning Group (the “CCG”), Torbay and South Devon NHS Foundation Trust (the “Trust”) and Torbay Council (“the Council”) in its role as commissioner of social care, and sets out the agreements made on the unresolved issues for 2016/17. The State acknowledges that due to circumstances beyond the control of the MCOs and the State, the established capitation rates may not be appropriate for the services to be provided. Even with utilization data and experience serving enrollees, it is difficult for the plans and the State to accurately predict the actual performance or utilization of services by the enrolled population. It is possible that more recipients will utilize more services than estimated, or that unit costs may exceed estimates. Conversely, it is also possible that more recipients will utilize substantially fewer services than estimated, or that unit costs are lower.

Model Risk Share Agreement Synopsis “Appropriateness” for use as the Rochdale Risk Share Salford Salford’s model concentrates heavily on in-year pressures being mitigated in-year, but ultimately it notes that "overspend is shared across partners of the pool, based on their initial opening financial contribution" This model fits well with the Rochdale ethos of a pooled integrated budget with an emphasis on the mitigation of all “in-year” pressures with the risk share agreement being used as a last resort. It is therefore recommended that the Rochdale risk share model be based on this, with deficits (or surpluses) being allocated based on their initial opening financial contribution to the Pooled Fund. Tameside Tameside’s model calculates the risk share based on the full budget including "aligned" and "in collaboration" budgets.
