OBJECTION to Tomkiewicz/Fortier Heritage Water Subdivision Exemption Submitted by Jorian & Mara Sartorius 12/6/2021 I. ACCESS/Roadway agreement The roadway agreement 223466 described in book 459, pages 505-507, pertains to a deeded easement providing access to four parcels of land, from US Highway 50. While this easement is 60 feet wide, the developed roadway and bridge over the South Arkansas River are single lane. The bridge was constructed in 1996 and designed to serve the needs of that time, which consisted of one single dwelling on parcel A. There are numerous blind spots on the existing road, and the roadway is inadequate to safely serve even the existing traffic level, as it now includes commercial traffic generated by Tomkiewicz-Fortier's commercial short term rental clientele. Further, the Roadway Agreement specifies that the cost of maintaining the roadway is split evenly between the four existing parcels.
