Florio purchased a home from the builder. One clause in the agreement provided that the vendor was to construct a bungalow with nine-foot ceilings. Another clause provided that the bungalow was to have 10-foot ceilings. Florio altered the wording of the contract by providing that the vendor was to built a bungalow in accordance with the sketch he produced and this alteration created the ambiguity. He argued that the Tribunal failed to apply the contra proferentum rule against the builder in dealing with this ambiguity.
