WHEREAS, the City and the Company previously authorized and executed a certain Sanitary Sewer Services Agreement, dated March 12, 2012 (the “Original Agreement”) which established the Company’s use of the City’s sanitary sewer utility system (the “Sewer System”) for the provision of sanitary sewer services to its now-completed manufacturing plant; and

The agreement is unique to Cargill in that they are the City's only industrial customer with a fully functioning waste water treatment plant that is capable of treating their waste water to effluent quality. Cargill's waste water is pumped to the City's plant to be disinfected, then discharged to the Des Moines River.
