Services provided by COMPANY under this Agreement will be performed in a manner consistent with that degree of care and skill ordinarily exercised by members of the same profession currently practicing at the same time and in the same or similar locality.

Although Qualcomm does not agree that Nokia has a reasonable basis to include all classes of devices in each functionality request, Qualcomm agrees to include that language in order to finalize things. That is, by including the additional classes of devices, Qualcomm does not suggest that there exists responsive representative documents related to same.
