SUMMARY OF SECOND AMENDMENT: The parties encountered a problem in attempting to complete the scope of work in the first amendment, described below: an interpretation by the Department of Ecology that, under the language of the grant program’s funding proviso, the water right on which the application was to be predicated was not eligible for funding. Rather than complete application as contemplated, the parties instead took steps to secure the continuation and reinterpretation of that funding into the next biennium and began to search in earnest for a different water right to support the application. These items supplanted the application work in the First Amendment; an extension and increase in the monetary amount is needed to continue the work of finding an additional water right and to complete the application.
