The Terms and Conditions (“Agreement”), by and between Con-way Multimodal Inc. (“CMM”), in its capacity as a broker arranging for motor carrier transportation of property “(Arranged Services”) and customers not otherwise contracted with CMM (“Customer”), provides as follows.
