WHEREAS, on or about January 11, 1984, the Borough and the Township entered into an lntermunicipal Sewer Agreement (the "1984 Agreement") wherein the Borough agreed to receive and to transport sewage waste from various developments in the Township to the Borough's Taylor Run and Goose Creek Waste Water Treatment Plants for treatment pursuant to the terms and conditions in the 1984 Agreement; and

The Parties first entered into that certain Sewer Capacity Agreement dated November 14th, 2017 (the “Sewer Capacity Agreement”) wherein the Borough granted the Township the right to discharge Sewage Waste into the Borough’s Sewage Collection System for transportation to the Treatment Plant for treatment.
