This Software and Hardware Support Services Maintenance Agreement (“Support Agreement”) is entered into effective this 7th day of May, 2012 (the “Effective Date”) by and between City of Pittsburg Water Utilities, located at 65 Civic Ave, Pittsburg, CA 94565 (“Customer”), and Badger Meter, Inc., a Wisconsin corporation with its principal place of business located at 4545 West Brown Deer Road, Milwaukee, WI 53224 (“Badger Meter”). Under this Support Agreement, Customer and Badger Meter are referred to individually as a “Party” and collectively as the “Parties.”
