The capitalized terms as used in this Agreement shall have the meanings set out in Exhibit A (Definitions) to this Agreement. Accenture and Client are also each referred to under the Agreement individually as a “Party,” and together as the “Parties.”

This Evaluation Agreement sets forth the terms and conditions under which Customer may access: (i) certain of Service Provider’s applications as specifically enrolled by Customer on the Evaluation Form (“Applications”) through Service Provider’s Software as a Service offering, and (ii) and user documentation that Service Provider makes generally available in hard copy or electronic form to its general customer base in conjunction with the subscription of such Applications ("Documentation") solely for evaluation purposes pursuant to the terms of this Evaluation Agreement. The Applications and the Documentation will hereinafter collectively be referred to as the “Software”.
