GHz service. IDT Spectrum’s predecessor-in-interest, Winstar Communications, LLC (“Winstar”), entered into an agreement with ICNT, Inc. (“ICNT”), effective as of August 1, 2003, to permit ICNT to install one or more point-to-point links on the spectrum. Operation of the spectrum by ICNT began on January 15, 2004. The agreement contemplated that Winstar would provide spectrum services to ICNT until the effective date of the FCC’s secondary markets rules; ten days after the effective date of the rules, the agreement would convert to a spectrum lease. However, the parties did not file the lease notification with the FCC when interim procedures for filing spectrum manager leasing notifications became available on February 2, 2004.
