hereby agree that the enclosed Standard Material Transfer Agreement (SMTA) shall be applicable to the transfer of Plant Genetic Resources for Food and Agriculture other than those listed in Annex I of the International Treaty on Plant Genetic Resources for Food and Agriculture 1(hereinafter referred to as „Treaty”).

ILRI maintains a collection of almost 19,000 accessions of forage germplasm as a global public good in the genebank in Addis Ababa, Ethiopia. Most of the germplasm was acquired prior to the entry into force of the Convention on Biological Diversity. Any material acquired after the entering into force of the Convention on Biological Diversity was obtained with the understanding that it could be made available for any agricultural research, breeding and training purposes under the terms and conditions set out in the agreement between ILRI and FAO dated 26 October 1994. On 16 October 2006, ILRI signed an agreement with the Governing Body of the International Treaty on Plant Genetic Resources for Food and Agriculture (the Treaty) placing these in trust collections of forage germplasm within the purview of the Treaty.

The multilateral system facilitates the exchange of the plant genetic resources for food and agriculture (PGRFA) that are most important for food security and on which countries are most interdependent by setting out the terms and conditions on which that exchange will take place. The main content of these terms and conditions is set out in Part IV of the International Treaty on Plant Genetic Resources for Food and Agriculture (hereinafter ‘the Treaty’), in Articles 11, 12 and 13. These terms and conditions have been agreed to by the Contracting Parties in the exercise of their sovereign rights, on a multilateral basis, thus obviating the need (and transactional costs) of negotiating each exchange on a bilateral basis. The terms and conditions are incorporated in a standard material transfer agreement (SMTA) that was adopted by the governing body at its first session in June 2006. Article 12.4 of the Treaty requires that this SMTA be used for all transfers of PGRFA under the multilater
