Ord 1136ORDINANCE NO. 1136 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE, CALIFORNIA, APPROVING THE STATUTORY DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF RANCHO MIRAGE, AND FM 111, LLC REGARDING THE DEVELOPMENT OF A FERRARI AUTOMOBILE DEALERSHIP ON CERTAIN REAL PROPERTY LOCATED IN DISTRICT 5- HIGHWAY 111 EAST SPECIFIC PLAN WHEREAS, the City is a charter city and a political subdivision of the State of California; and WHEREAS, FM 111, LLC ("Developer") owns in fee eight (8) contiguous separate lots with Assessor Parcel Numbers ("APN") 684-200-018, APN 684-200- 019, APN 684-231-001, APN 684-231-002, APN 684 -231-004, APN 684 -231-005, APN 684-231 -007, and APN 684-231-008 ("Subject Property); and WHEREAS, four (4) of the lots, APN 684 -231 -001, APN 684-231-002, APN 684-231-007, and APN 684-231-008, are deemed legal nonconforming sites under the Rancho Mirage Municipal Co

This Statutory Development Agreement ("Agreement") is entered into this 1ST day of June 2021, by and between CITY OF BEAUMONT, a general law city and municipal corporation located in the County of Riverside, State of California ("City"), and USEF CROSSROADS I, LLC, a Delaware limited liability company. and USEF CROSSROADS II, LLC, a Delaware limited liability company (collectively, "Developer"), pursuant to the authority of Sections 65864 et seq. of the California Government Code and Beaumont City Council Resolution No. 1987-34.
