(“Bank of America”), in its capacity as Administrative Agent (as defined in the Credit Agreement described below) (in such capacity, the “Existing Agent”) and in such other capacities as are set forth in Section 13(b) below, FONTAINEBLEAU LAS VEGAS, LLC (the “Borrower”) and the Lenders (as defined below) listed on the signature pages hereto (the “Consenting Lenders”). Capitalized terms used herein without definition shall have the meanings attributed to such terms in the Credit Agreement.
