This Surface Use and Damage Agreement (Agreement) is made and entered into effective this 10th day of March 2011, by and between PCY Holdings LLC, a wholly owned subsidiary of Pure Cycle Corporation, as the owner of the surface of the lands described hereafter whose addresses is 1490 Lafayette Street, Suite 203, Denver, Colorado 80218 hereinafter referred to as “Owner”, and Anadarko E&P Company LP, whose address is 1099 18th Street, Suite 1800, Denver, CO 80202, hereinafter referred to as “Operator”.
