This is a legal agreement between you, either as an individual or as an authorized representative of your employer, referred to in this agreement interchangeably as “you” or “Licensee” and Freescale Semiconductor, Inc. doing business as Swell Software, a Delaware corporation with offices at 6501 William Cannon Drive West, Austin Texas 78735 (referred to in this Agreement as “Swell” or “Freescale”). It concerns your rights to use the Software and Tools as defined below. In consideration for Swell allowing you to access the Software and Tools, you are agreeing to be bound by the terms of this Agreement. If you do not agree to all of the terms of this Agreement, do not activate or install the Software or the Tools. If you change your mind later, stop using the Software and the Tools and delete all copies of the Software and Tools in your possession or control. Any copies of the Software that you have already distributed, where permitted, and do not destroy will continue to be governed by
