THIS TAX INCENTIVE PROGRAM AGREEMENT (the “Agreement") is made and executed effective this 26th day of June, 2018 (the “Effective Date”), by and between the CITY OF MANITOU SPRINGS, COLORADO, a Colorado home rule municipal corporation (the "City") and MANITOU & PIKE’S PEAK RAILWAY COMPANY, a Colorado Corporation with an address of One Lake Avenue, Colorado Springs, Colorado 80906 (the “Owner”) (individually a “Party” and collectively the “Parties”.
