These terms are an agreement between the Solutions and Support Center (the “S&SC”) and the customer identified in the S&SC-issued proposal (the “Named Customer”), as accepted by the entity that accepts the proposal (the “Accepting Party”). The accepted proposal is referred to herein as the “Order”.. If the Accepting Party is the Named Customer, then the Named Customer will be deemed “Customer” for purposes of this agreement. If the Accepting Party is not the Named Customer, then the Accepting Party states that it is acting on behalf of, and has the authority to bind, the Named Customer, and in such case, the Named Customer will be deemed “Customer” for purposes of this agreement. If the Accepting Party is financing or leasing the Product to the Named Customer (a “Third-Party Lessor”), it acquires no rights nor any obligations with respect to the financed or leased Products under this agreement except as provided in section 3(c)(1).
