In consideration of the payments to be made and obligations to be performed by Edison, Consultant shall perform the specified Work and its other obligations as an independent contractor (not as an employee or agent of Edison), all as set forth in the Purchase Order which incorporates these Terms and Conditions for Materials and Related Services. These Terms and Conditions for Materials and Related Services together with any attachments and Exhibits and other documents incorporated herein (“Terms and Conditions”) and the Purchase Order that incorporates these Terms and Conditions (collectively, the “Agreement”) are between Edison Material Supply LLC (EMS) and Contractor.
