This Agreement (the “Agreement”), effective as of the date You accept this Agreement (“Effective Date”), is by and between Harmonix Music Systems, Inc. whose principal place of business is at 625 Massachusetts Avenue, 2nd Floor, Cambridge, MA 02139 (“Harmonix”) and You, an individual, as a playtester (“You”/”Your” or “Tester”), relating to any and all content pertaining to the Game (defined below). Harmonix is engaged in the creation and development of an unreleased multiplayer online game with the title Chroma (the “Game”). If You are selected to be a Tester, Your confidential access to and participation in the Alpha and / or Beta Trial are subject to the following terms and conditions, which constitute a binding legal agreement between You and Harmonix, as of the Effective Date.
