The Council has a duty under section 18 of the Care Act 2014 and a power under section 19 of the Care Act 2014 to provide or arrange permanent care in accommodation of a specified type for adults with a need for care and support who are assessed as having eligible unmet needs which require this care. This duty also exists where The Council is discharging its duty under s. 117 of the Mental Health Act 1983 by providing or arranging the provision of accommodation for a person. In arranging such accommodation, local authorities should also be mindful of their duty under section 1 of the Care Act 2014 to promote individual wellbeing.
