This First Amendment to Tower Site Lease With Option (the “First Amendment”) is effective as of the last signature below (the “Effective Date”), by and between City of Lake Wales, a municipal corporation of the State of Florida (“Landlord”), and T-Mobile South LLC, a Delaware limited liability company, successor in interest to APT Tampa/Orlando, Inc. (“Tenant”) (each a “Party”, or collectively, the “Parties”).

This Tower Site Lease (“Lease”) is entered into by and between Pasco County, a political subdivision of the State of Florida, by and through its Board of County Commissioner, with an address of 8731 Citizens Drive, New Port Richey, Florida, 34654 (“Lessor”), Vertex Development, LLC, a Delaware limited liability company (“Lessee”), with an address of 3630 West Kennedy Boulevard, Tampa, Florida 33609, and the District School Board of Pasco County, Florida with an address of 7227 Land O’Lakes Blvd., Land O’Lakes, Florida 34638 (“District School Board”).
