BC Rolling Green LLC (“Grantor”), a Massachusetts limited liability company, having an address of c/o Beacon Communities LLC, 2 Center Plaza, Suite 700, Boston, Massachusetts 02108, for consideration of One Million Two Hundred Fifty Thousand Dollars ($1,250,000.00), hereby grants, with Quitclaim Covenants, to the Town of Amherst, Massachusetts, a Massachusetts municipal corporation (the “Municipality” or the “Town”), having an address of Amherst Town Hall, 4 Boltwood Avenue, Amherst, Massachusetts 01002, its successors and assigns, or its designee, exclusively for the purpose of ensuring retention of housing for occupancy by low income individuals and households, the following described Affordable Housing Restriction (this “Restriction”) on certain property located at 422 Belchertown Road, Amherst, Massachusetts, said land being described in Exhibit A attached hereto, and all improvements now or hereinafter located thereon (collectively, the “Property”).
