All construction activities conducted within MDTA right-of-way or within an easement acquired by MDTA for the purpose of this project is exempt from compliance with State and Local noise laws. However, any construction activities that are performed within an area that has been acquired through a right-of-entry by MDTA or within an area of land acquired by an agreement between the property owner and the Contractor outside of this Contract shall be limited to the noise regulations specified under COMAR, Title 26.
