This agreement together with two EU Regulations, the Unitary Patent Regulation (1257/2012) and the Translations Regulation (1260/2012), both of which had been adopted by the European Parliament the previous December, will finally bring into being something akin to a Community Patent and a Community Patent Court. To appreciate the implications of this to industry and in particular the pharmaceutical industry, it is absolutely critical to understand the nature of both the new patent right and the new court.
