THIS USE AGREEMENT (the “Agreement”) is made and entered into as of the Effective Date, as that term is defined in Section IX K, below, by and between POLK COUNTY, FLORIDA, a political subdivision of the State of Florida, (the “County”) and the CITY OF WINTER HAVEN, FLORIDA, a Florida Municipal Corporation (the “City”); each singularly a “party” and together, “the parties,” to this Agreement with reference to the following facts and subject to the following terms and conditions.

THIS FIRST AMENDED AGREEMENT (“Agreement”) is made this 12th day of September, 2017, by and between the Alameda Unified School District, a public school district organized and existing under the laws of the State of California (“District”) and Community Learning Center Schools, Inc., (“CLCS”) a California non-profit public benefit corporation operating two public charter schools in Alameda (Nea Community Learning Center, or “Nea” and Alameda Community Learning Charter School, or “ACLC”, collectively the “CLCS Charter Schools”). The District and CLCS are each a “Party” and collectively referred to as “the Parties.”
