This Business Associate Agreement (the “BAA”), is made as of the date this BAA is executed by both Parties (the “Effective Date”), by and between United HealthCare Services, Inc., on behalf of itself and its affiliates (“Business Associate”) and the City of Columbia, Missouri, a municipal corporation and hybrid covered entity (“Covered Entity”) (collectively the “Parties”) in order to comply with the Federal Health Insurance Portability and Accountability Act of 1996 and its related regulations (“HIPAA”), the Health Information Technology for Economic and Clinical Health Act, Title XIII of the American Recovery and Reinvestment Act of 2009 and related regulations promulgated by the Secretary (the “HITECH”).
