The United States-Mexico-Canada Agreement (USMCA), as dubbed by the United States; the Canada- United States – Mexico Agreement (CUSMA) known in Canada; and the México, Estados Unidos y Canadá (T-MEC) in Mexico; replaces the universally known NAFTA or North American Free Trade Agreement on July 1, 2020. The new agreement modernizes NAFTA and addresses some key issues facing Colorado manufacturers, such as: harmonization of regulatory systems, e-commerce, and protection of intellectual property.

After several years of negotiation, the United States-Mexico-Canada Agreement (USMCA) entered into force on July 1, 2020.1 The USMCA updated and in some respects significantly changed the original North America Free Trade Agreement (NAFTA) that had been in effect since January 1, 1994. With some important excep- tions, including limits on excessive protections for foreign investment and strengthened labor and environ- mental protections,2 many of the new provisions expand corporate rights in the name of trade liberalization and seek to narrow the scope of domestic regulation of all three signatory countries.

This new agreement between the countries of North America also includes a mechanism for dispute settlement to handle conflicts arising in labor matters. This is found in Chapter 31 and its annexes, which has the purpose of providing an immediate response to a Denial of Rights. During the process of this mechanism, companies will have the opportunity to remedy the violation in question.

The U.S.-Mexico-Mexico Agreement (USMCA) is a trade agreement between these parties. The USMCA replaced the North American Free Trade Agreement (NAFTA). The second parallel agreement is the North American Environmental Cooperation Agreement (NAAEC), which established the Commission for Environmental Cooperation (CEC) in 1994. The CEC is responsible for strengthening regional cooperation in the environmental field, reducing potential trade and environmental conflicts and promoting effective enforcement of environmental legislation. It also facilitates public cooperation and participation in efforts to promote conservation, protection and improvement of the North American environment. It consists of three main components: the Council (Minister of the Environment), the Joint Advisory Committee of Governments (JPAC) and the Secretariat, which is headquartered in Montreal.
