THIS AGREEMENT, effective this 16th day of November, 2015, (the “Effective Date”) by and between VIRGINIA ELECTRIC AND POWER COMPANY, a Virginia public service corporation with its principal office in Richmond, Virginia, doing business in Virginia as Dominion Virginia Power, and in North Carolina as Dominion North Carolina Power, hereinafter called “Dominion North Carolina Power” or the “Company,” and Battleboro Farm, LLC a North Carolina limited liability company with its principal office in Santa Monica, California, hereinafter called “Operator.” Both Dominion North Carolina Power and Operator also are herein individually referred to as “Party” and collectively referred to as “Parties”:
