THIS WATER CARRIAGE AGREEMENT (hereinafter “ Carriage Agreement”) is entered into this day of , 2022 (“Effective Date”), by and between Town of Firestone, a Colorado municipal corporation, acting by and through its Town of Firestone Water Activity Enterprise organized and existing as a water activity enterprise under C.R.S. § 37-45.1-101 et seq., whose address is 9950 Park Avenue, Firestone, Colorado 80520 (“Firestone”) and L.G. Everist, Inc., a South Dakota corporation whose address is 7321 East 88th Avenue, Suite 200, Henderson, Colorado 80640 (“LGE”). Firestone and LGE may be referred to herein collectively as “Parties” or individually as “Party.”
