Notion of undertaking. (81) The Commission notes that the State aid rules only apply where the recipient of an aid is an 'undertaking'. According to set- tled case law, an undertaking is an entity engaging in an economic activity regardless of its legal status and the way in which it is financed (72). Any activity consisting in offering goods and/or services in a given market is an economic activity (73).
