Bez ohledu na ostatní ustanovení Rámcové smlouvy se Klient a Banka dohodli na tom, že budou-li Bance během platnosti akreditivu či po jeho platnosti předloženy dokumenty uvedené v akreditivu, které vykazují vady, nebo budou Bance předloženy bezvadné dokumenty po platnosti akreditivu, je Banka dle svého uvážení oprávněna odmítnout předložené dokumenty nebo požádat Klienta o akceptaci předložených dokumentů a jeho souhlas s plněním z akreditivu. Pokud Banka, na základě akceptace a souhlasu Klienta dle předchozí věty učiněné písemně v listinné podobě nejpozději do 60 Obchodních dnů po platnosti akreditivu, poskytne požadované plnění, vznikne tímto Bance pohledávka za Klientem dle Rámcové smlouvy. Submitted Documents. Regardless of the other provisions of the Frame Agreement, the Client and the Bank have agreed that if the documents specified in the letter of credit are submitted to the Bank during or after the validity of the letter of credit and prove to be defective or if defect-free documents are submitted to the Bank after the validity of the letter of credit, the Bank shall be entitled, at its discretion, to reject the submitted documents or request the Client to accept the submitted documents and agree to the performance under the letter of credit. If the Bank, based on the Client’s acceptance and consent under the previous sentence made in writing no later than within 60 Business Days of the maturity of the letter of credit, provides the required performance, a receivable arises for the Bank in respect of the Client under the Frame Agreement.
