Preambule
Tato zadávací dokumentace je zpracována v souladu se zákonem č. 134/2016 Sb. zák. České republiky, o zadávání veřejných zakázek, v platném znění a v souladu s ostatními závaznými právními předpisy. Práva a povinnosti neuvedené v této zadávací dokumentaci se řídí zákonem. Celé zadávací řízení vedené na základě této zadávací dokumentace a rovněž i smluvní vztah, vzniklý na základě výsledku zadávacího řízení mezi zadavatelem a vybraným dodavatelem se řídí právním řádem České republiky v souladu s ust. § 87 odst. 1 zák. č. 94/2012 Sb. zák. České republiky o mezinárodním právu soukromém.
Zadávací řízení je vyhlášeno v souladu s ustanovením § 211 odst. 3 zákona, na základě něhož musí písemná komunikace mezi zadavatelem a dodavatelem probíhat elektronicky a to prostřednictvím elektronického nástroje nebo datové schránky. Zadavatel ve smyslu ustanovení § 103 odst. 1 písm. c) zákona stanoví, že nabídky je možné v zadávacím řízení podávat pouze elektronicky, tak jak je dále upraveno v zadávací dokumentaci. Zadavatel v této souvislosti upozorňuje, že veškerá podání, která by dodavatel vůči zadavateli v rámci tohoto zadávacího řízení činil v listinné formě, jsou v souvislosti s výše uvedenými podmínkami zadávacího řízení vůči zadavateli neúčinná.
Preamble
This contractual documentation has been prepared in compliance with Act No. 134/2016 Coll. of the Czech Republic, on Public Procurement, as amended, and in compliance with other binding legal regulations. Rights and obligations not stated in this contractual documentation are governed by the Act. The entire tender proceedings conducted based on this contractual documentation as well as the contractual relation, arisen based on the result of the tender proceedings between the customer and the selected contractor, are governed by legal regulations of the Czech Republic in compliance with the stipulations of Section 87, Paragraph 1, Act No. 94/2012 Coll. of the Czech Republic on the Private International Law.
The tender proceedings are announced in compliance with the stipulations of Section 211, Paragraph 3 of the Act, based on which the written communication between the customer and the contractor has to take place in an electronic form via an electronic instrument or a data box. Pursuant to the stipulations of Section 103, Paragraph 1, Letter c) of the Act, the customer declares that offers for this tender can be submitted only electronically and in the manner specified further in the contractual documentation. In relation to the above stated facts, the customer declares that any communication conducted by the contractor within the frame of this tender proceedings in the printed form is, in relation to the above stated conditions of the tender proceedings, ineffective.
Článek I
Vymezení předmětu zakázky a technické podmínky
Předmětem veřejné zakázky (dále také VZ) je dodávka mobilního indentačního zařízení, včetně kompletního příslušenství, návodů na obsluhu a údržbu, včetně dopravy do místa plnění a zaškolení zaměstnanců zadavatele s obsluhou a údržbou. Podrobná technická specifikace předmětu dodávky je uvedena v příloze č. 1 této zadávací dokumentace.
Při podání nabídky je nutné, aby byly dodrženy všechny závazné technické parametry uvedené v příloze č. 1. Zadavatel výslovně upozorňuje dodavatele, že požadované zařízení je určeno k použití ve stísněných prostorech, ve výškách, na vysutých konstrukcích, lešeních či v jinak omezených prostorech. Se zařízením mohou pracovat jak muži, tak také ženy, proto je nutno dodržovat stanovené váhové limity, odpovídající parametrům ručního nářadí. K vyloučení dodavatele pro nesplnění podmínek zadávací dokumentace povede stav, kdy nebudou dodrženy všechny závazné technické parametry požadovaného plnění.
Předpokládaná hodnota veřejné zakázky je 6 750 000 Kč bez DPH (8 167 500 Kč vč. DPH).
Article I
Specification of the subject of the contract and technical conditions
The subject of the public contract (hereinafter also referred to as “PC”) is the delivery of a mobile indentation device, including complete accessories, operation and maintenance manuals, transportation to the implementation location and operation and maintenance training of the customer employees. A detailed technical specification of the subject of the delivery is included in Appendix 1 to this contractual documentation.
When submitting an offer, it is necessary, to comply with all the binding technical parameters stated in Appendix 1. The customer explicitly notifies the contractor that the required device is designated for being used in cramped areas, at heights, on suspended structures, on scaffoldings or in other confined areas. The device can be operated by men and women. That is why the specified weight limits, which correspond to hand tool parameters, have to be complied with. Contractors will be excluded from the tender for not complying with the conditions of the contractual documentation if all the binding technical parameters of the required implementation are not complied with.
The expected value of the public contract amounts to 6,750,000 CZK, excluding VAT (8,167,500 CZK, including VAT).
Místem plnění předmětu veřejné zakázky je areál Vysoké školy báňské – Technické univerzity Ostrava, Centrum pokročilých inovačních technologií,

Doba plnění veřejné zakázky je 60 dnů od nabytí účinnosti smlouvy
Pokud jsou v této zadávací dokumentaci obsaženy požadavky nebo odkazy na jednotlivá obchodní jména, zvláštní označení podniku, zvláštní označení výrobků, výkonů anebo obchodních materiálů, která platí pro určitý podnik nebo organizační jednotku za příznačné, popř. patenty a užitné vzory, jsou uvedeny pouze pro upřesnění a přiblížení technických parametrů a zadavatel umožňuje použití i kvalitativně a technicky obdobného řešení v souladu s ustanovením § 89 odst. 6 zákona.
Článek II
Prohlídka místa plnění
Zadavatel, s ohledem na charakter předmětu veřejné zakázky, prohlídku místa plnění nestanovuje.
Článek III
Prokázání kvalifikačních předpokladů
Zadavatel požaduje prokázání základní způsobilosti v souladu s ustanovením § 74 zákona.
The implementation location of the subject of the public contract are the premises of VSB – Technical University of Ostrava, Centre of Advanced Innovation Technologies, 17. listopadu 2172/15, 708 00 Ostrava – Poruba, Czech Republic.
The public contract fulfilment period is 60 days after the contract coming into effect.
Should this technical documentation include requirements for or references to individual business names, special plant designations, special product, activity or business material designations, which specifically apply to a certain plant or organizational unit, or patents and utility models, these are stated only for clarifying individual technical parameters and the customer allows for using other solutions that are analogous from the qualitative and technical perspective pursuant to the stipulations of Section 89, Paragraph 6 of the Act.
Article II
Inspection of the implementation location
Due to the nature of the subject of the public contract, the customer does not organize any inspection of the implementation location.
Article III
Demonstration of the qualification conditions
The customer requires a demonstration of the basic qualification in compliance with the stipulations of Section 74 of the Act.
Způsobilým není dodavatel, který:
a) byl v zemi svého sídla v posledních 5 letech před zahájením zadávacího řízení pravomocně odsouzen pro trestné činy, jejichž výčet je v závorce na konci textu nebo obdobný trestný čin podle právního řádu země sídla dodavatele (trestný čin spáchaný ve prospěch organizované zločinecké skupiny nebo trestný čin účasti na organizované zločinecké skupině; trestný čin obchodování s lidmi; tyto trestné činy proti majetku (podvod, úvěrový podvod, dotační podvod, podílnictví, podílnictví z nedbalosti, legalizace výnosů z trestné činnosti, legalizace výnosů z trestné činnosti z nedbalosti); trestné činy hospodářské (zneužití informace a postavení v obchodním styku, sjednání výhody při zadání veřejné zakázky, při veřejné soutěži a veřejné dražbě, pletichy při zadání veřejné zakázky a při veřejné soutěži, pletichy při veřejné dražbě, poškození finančních zájmů Evropské unie); trestné činy obecně nebezpečné; trestné činy proti České republice, cizímu státu a mezinárodní organizaci; trestné činy proti pořádku ve věcech veřejných (trestné činy proti výkonu pravomoci orgánu veřejné moci a úřední osoby, trestné činy úředních osob, úplatkářství, jiná rušení činnosti orgánu veřejné moci), k zahlazeným odsouzením se nepřihlíží,
The contractor is not qualified if:
a) The contractor has been, during the last 5 years prior to the commencement of the tender, sentenced for criminal acts, a list of which is included in the parentheses at the end of the text, or for a similar criminal act pursuant to the criminal code of the country where the contractor has its address (a criminal act committed for the benefit of an organized criminal group or a criminal act of participating in activities of an organized criminal group; criminal act of human trafficking); the following property criminal acts (fraud, credit fraud, grant fraud, handling of stolen goods, handling of stolen goods due to negligence, legalization of revenues from criminal activities due to negligence); economic criminal acts (abusing information and position in a business relation, organizing an advantage when preparing a public contract, public tender and public auction, plotting when preparing a public contract and public tender, plotting when organizing a public auction, damaging financial interests of the European Union); generally dangerous criminal acts; criminal acts committed against the Czech Republic, a foreign state and an international organization; criminal acts committed against the order of public affairs (criminal acts committed against the implementation of the rights of state administration authorities and public officers, criminal acts public officers, bribery, other disruption of the activities of state administration authorities); sentences that have been swept away are not taken into account,
b) má v České republice nebo v zemi svého sídla v evidenci daní zachycen splatný daňový nedoplatek,
c) má v České republice nebo v zemi svého sídla splatný nedoplatek na pojistném nebo na penále na veřejné zdravotní pojištění,
d) má v České republice nebo v zemi svého sídla splatný nedoplatek na pojistném nebo na penále na sociální zabezpečení a příspěvku na státní politiku zaměstnanosti,
e) je v likvidaci, nebo proti němu bylo vydáno rozhodnutí o úpadku, vůči němuž byla nařízena nucená správa podle jiného právního předpisu nebo v obdobné situaci podle právního řádu země sídla dodavatele.
Je-li dodavatelem právnická osoba, musí podmínku podle písm. a) splňovat tato právnická osoba a zároveň každý člen statutárního orgánu. Je-li členem statutárního orgánu dodavatele právnická soba, musí podmínku podle písm.
a) splňovat tato právnická osoba, každý člen statutárního orgánu této právnické osoby a osoba zastupující tuto právnickou osobu v statutárním orgánu dodavatele.
Dodavatel prokáže splnění základní způsobilosti předložením dokladů ve vztahu k České republice v souladu s ustanovením § 75 zákona a to:
- výpisy z evidence rejstříku trestů ve vztahu k § 74 odst. 1 písm. a),
b) The contractor has outstanding tax arrears in the tax recording system in the Czech Republic or in the country of its residency,
c) The contractor has outstanding arrears in the area of insurance or penalty in the public health insurance in the Czech Republic or in the country of its residency,
d) The contractor has outstanding arrears in the area of insurance or penalties in the social security system and contribution to national employment policy in the Czech Republic or in the country of its residency,
e) The contractor is the subject of bankruptcy proceedings, or if a bankruptcy decision has been issued with regard to the contractor, against which a forced administration was ordered pursuant to another legal regulation or the contractor is in an analogous situation in accordance with the legal system of the country where the contractor has its seat.
Should the contractor be a legal entity, the condition pursuant to Letter a) must be fulfilled by this legal entity and, at the same time, by all members of its statutory body. Should a member of the statutory body of the contractor be a legal entity, the condition pursuant to Letter a) must be fulfilled by this legal entity, all members of the statutory body of this legal entity and the person that represents this legal entity in the statutory body of the contractor.
The contractor should demonstrate its compliance with the basic qualification requirement by providing documents in relation to the Czech Republic pursuant to the stipulations of Section 75 of the Act, particularly:
- Excerpts from the criminal record in relation to Section 74, Paragraph 1, Letter a),
- potvrzení příslušného finančního úřadu ve vztahu k § 74 odst. 1 písm. b),
- písemného čestného prohlášení ve vztahu ke spotřební dani ve vztahu k § 74 odst. 1 písm. b),
- - písemného čestného prohlášení ve vztahu k § 74 odst. 1 písm. c),
- - potvrzení příslušné okresní správy sociálního zabezpečení ve vztahu k § 74 odst. 1 písm. d),
- - výpisu z obchodního rejstříku nebo předložením písemného čestného prohlášení v případě, že není v obchodním rejstříku zapsán, ve vztahu k § 74 odst. 1 písm. e),
Zadavatel požaduje prokázání profesní způsobilosti v souladu s ustanovením § 77 odst. 1 zákona předložením níže uvedeného dokladu:
• výpis z obchodního rejstříku nebo jiné obdobné evidence, pokud jiný právní předpis zápis do takové evidence vyžaduje nebo živnostenské oprávnění, pokud dodavatel v obchodním rejstříku nebo v jiné obdobné evidenci není veden.
Zadavatel upřednostňuje prokázání kvalifikační způsobilosti formou odkazu na odpovídající informace vedené v informačním systému veřejné správy, tedy odkaz na internetovou stránku obsahující požadovaný dokument, například internetovou stránku obchodního rejstříku.
- Confirmation of the corresponding financial office in relation to Section 74, Paragraph 1, Letter b),
- Written statutory declaration in relation to the excise tax in relation to Section 74, Paragraph 1, Letter b),
- Written statutory declaration in relation to Section 74, Paragraph 1, Letter c),
- Confirmation of the corresponding district social security administration in relation to Section 74, Paragraph 1, Letter d),
- Excerpt from the Companies Register or a written statutory declaration if the contractor is not registered in the Companies Register in relation to Section 74, Paragraph 1, Letter e),
The customer requires a demonstration of the appropriate professional qualification in compliance with the stipulation of Section 77, Paragraph 1 of the Act by submitting the following document:
• Excerpt from the Companies Register or another, analogous register, provided the given other legal regulation requires a corresponding record in such a register, or a trade license certification, provided the contractor is not registered in the Companies Register or in another, analogous register.
The customer prefers that the contractor demonstrates its qualification ability in the form of a reference to the appropriate information kept in the state administration information system, i.e. a link to the website that contains the required document, for example, the website of the Companies Register.
Doklady prokazující základní způsobilost podle § 74 a profesní způsobilost podle § 77 odst. 1 musí prokazovat splnění požadovaného kritéria způsobilosti nejpozději v době 3 měsíců přede dnem zahájení zadávacího řízení.
Dodavatel může nahradit požadované dokumenty jednotným evropským osvědčením pro veřejné zakázky.
Prokázání splnění kvalifikace u zahraničního dodavatele
V případě, že byla kvalifikace získána v zahraničí, prokazuje se doklady vydanými podle právního řádu země, ve které byla získána, a to v rozsahu požadovaném zadavatelem.
Článek IV
Vysvětlení zadávací dokumentace
Zadavatel může zadávací dokumentaci vysvětlit, pokud takové vysvětlení, případně související dokumenty, uveřejní na profilu zadavatele, a to nejméně 5 pracovních dnů před uplynutím lhůty pro podání nabídek.
Documents that demonstrate the basic qualification pursuant to Section 74 and professional qualification pursuant to Section 77, Paragraph 1, have to demonstrate fulfilment of the required qualification criterion 3 months prior to the commencement of the tender proceedings, at the latest.
The contractor can substitute the required documents by a unified European certification for public contracts.
Demonstrating compliance with the qualification requirement by foreign contractors
Should the given qualification be gained abroad, the contractor should demonstrate its qualification by documents issued in accordance with the legal regulations of the country where it was gained in the extent required by the customer.
Article IV
Explanation of the contractual documentation
The customer can explain the contractual documentation if the customer publishes such an explanation or related documents on the customer profile at least 5 working days prior to the expiry of the deadline for submitting the offers.
Pokud o vysvětlení zadávací dokumentace písemně požádá dodavatel, zadavatel vysvětlení uveřejní, odešle nebo předá včetně přesného znění žádosti. Zadavatel není povinen vysvětlení poskytnout, pokud není žádost o vysvětlení doručena včas, a to alespoň 3 pracovní dny před uplynutím lhůty podle předchozího odstavce. Pokud zadavatel na žádost o vysvětlení, která není doručena včas, vysvětlení poskytne, nemusí dodržet lhůtu podle předchozího odstavce.
Pokud je žádost o vysvětlení zadávací dokumentace doručena včas a zadavatel neuveřejní, neodešle nebo nepředá vysvětlení do 3 pracovních dnů, prodlouží lhůtu pro podání nabídek nejméně o tolik pracovních dnů, o kolik přesáhla doba od doručení žádosti o vysvětlení zadávací dokumentace do uveřejnění, odeslání nebo předání vysvětlení 3 pracovní dny.
Pokud by spolu s vysvětlením zadávací dokumentace zadavatel provedl i změnu zadávacích podmínek, postupuje podle § 99 zákona.
Jelikož je celá zadávací dokumentace volně přístupná na profilu zadavatele, zadavatel nezná a ani znát nemůže údaj o tom, kteří dodavatelé využili neomezeného dálkového přístupu k zadávací dokumentaci a nezná tedy ani všechny adresy, na které by měl poskytovat vysvětlení zadávací dokumentace. Zadavatel však vždy uveřejní vysvětlení zadávací dokumentace včetně přesného znění žádosti na profilu zadavatele. Z těchto důvodů doporučuje zadavatel všem dodavatelům, aby pravidelně sledovali profil zadavatele.
Should the contractor ask for an explanation of the contractual documentation in writing, the customer should publish, send or submit the corresponding explanation, including the exact wording of the request. The customer is not obliged to provide any explanation if the given request for an explanation is not submitted in a timely manner, i.e. at least 3 working days prior to the expiry of the deadline pursuant to the previous paragraph. Should the customer provide an explanation upon a request for an explanation that has not been submitted on time, the customer is not obliged to comply with the deadline pursuant to the previous paragraph.
Should a request for an explanation of the contractual documentation be submitted in a timely manner and should the customer not publish, send or submit the corresponding explanation within 3 working days, the customer should extend the deadline for submitting the offers by at least as many of working days by which the time from the delivery of the request to publishing, sending or submitting the explanation exceeded the above mentioned 3 working days.
Should the customer change the contractual conditions simultaneously with a given explanation of the contractual documentation, the customer should proceed in accordance with Section 99 of the Act.
Since the entire contractual documentation is freely accessible on the customer profile, the customer does not know and cannot know which contractors have used the unlimited remote access to the contractual documentation. As a result, the customer cannot know all the addresses, to which it should provide a given explanation of the contractual documentation. Nevertheless, the customer has to always publish the given explanation of the contractual documentation including the wording of the corresponding request on the customer profile. That is why the customer encourages all contractors to regularly monitor the customer profile.
Článek V Obchodní podmínky
Obchodní podmínky veřejné zakázky jsou uvedeny v návrhu smlouvy. Návrh smlouvy je přílohou č. 2 této zadávací dokumentace. Nedílnou součástí návrhu smlouvy bude příloha – technická dokumentace.
Dodavatel v návrhu smlouvy vyplní příslušné požadované údaje, jiné úpravy není dodavatel oprávněn v návrhu smlouvy provádět.
Článek VI
Požadavky na varianty, jistota, zadávací lhůta, vyhrazená změna závazku
Zadavatel nepřipouští variantní řešení. Zadavatel nepožaduje poskytnutí jistoty.
Zadavatel stanovuje délku zadávací lhůty na 90 dnů
Článek VII
Požadavky na způsob zpracování nabídkové ceny
Article V Business conditions
The public contract business conditions are included in the contract proposal. The contract proposal forms Appendix 2 of this contractual documentation. A technical documentation appendix will form an integral part of the contract proposal.
The contractor should enter the required information in the contract proposal. The contractor des not have the right to make any other amendments to the contract proposal.
Article VI
Requirements for individual alternatives, security, implementation period, reserved obligation change
The customer does not permit any alternative solution. The customer does not require provision of any security.
The customer determines that the implementation period amounts to 90 days.
Article VII
Requirements for the offer price processing manner
Dodavatel stanoví celkovou závaznou nabídkovou cenu v Kč bez daně z přidané hodnoty. Nabídkovou cenu uvede do návrhu smlouvy.
Nabídková cena bude stanovena jako cena nejvýše přípustná a musí v ní být zahrnuty veškeré náklady spojené s kompletní realizací celého rozsahu předmětu zakázky.
Článek VIII
Podmínky a požadavky na zpracování nabídky
Dodavatel podává jednu nabídku.
Nabídka bude předložena v českém jazyce nebo anglickém jazyce.
K dokladům a listinám předloženým v jiném než českém nebo anglickém jazyce musí být připojen jejich překlad do českého nebo anglického jazyka. Podmínka překladu do českého jazyka nebo anglického jazyka se týká taktéž prospektů, technických popisů a technických listů nabízených výrobků. Povinnost přiložit překlad do českého jazyka se nevztahuje na doklady v jazyce slovenském.
Dodavatel ve své nabídce uvede své identifikační údaje v rozsahu stanoveném v krycím listu nabídky – viz příloha č. 3.
The contractor should specify a total binding price in CZK, excluding the value added tax. The contractor should enter the offer price to the contract proposal.
The offer price should be specified as the highest permitted price and it has to include all expenses related to the complete implementation of the entire extent of the subject of the contract.
Article VIII
Conditions and requirements related to the preparation of the offers
Each contractor should submit only one offer.
Offers should be submitted in the Czech or English language. All documents submitted in other languages have to be accompanied by corresponding translations to the Czech or English language. This translation condition also applies to leaflets, technical descriptions and technical sheets of the offered products. The obligation to attach a translation to the Czech language does not apply to documents provided in the Slovak language.
The contractor should state its identification data in its offer in the extent specified on the offer cover sheet – see Appendix 3.
Minimální identifikační údaje jsou: název obchodní firmy, sídlo/místo podnikání/bydliště, jméno osoby oprávněné jednat za dodavatele, IČ, DIČ, telefon, e-mail (pro komunikaci v průběhu procesu zadávání zakázky).
Dodavatel podpisem na krycím listu nabídky stvrzuje závaznost podané nabídky.
Součástí nabídky budou rovněž další dokumenty požadované zákonem a zadavatelem, včetně dokladů a informací prokazujících splnění kvalifikace v souladu s ustanovením části čtvrté, hlava VIII, oddíl 1 zákona.
Nabídka dodavatele nesmí obsahovat takové přepisy nebo opravy, které by mohly uvést zadavatele v omyl.
Zadavatel požaduje, aby nabídku dodavatele tvořily alespoň tyto dokumenty:
- úplně vyplněný krycí list nabídky ve struktuře dle přílohy č. 3,
- návrh smlouvy v souladu s přílohou č. 2,
- doklady prokazující splnění kvalifikace,
- podepsané čestné prohlášení ke kvalifikaci dle přílohy č. 4,
- další doklady, které dodavatel hodlá předložit.
The following are the minimal required identification data: company name, business/residency seat/address, name of the person authorized to act on behalf of the contractor, business identification number, tax identification number, phone number, email (for communication during the contract tender process).
The contractor confirms the binding character of its offer by signing the cover sheet of its offer.
A part of the offer should be also formed by other documents required by the applicable legal regulations and by the customer, including documents and information that demonstrate compliance with the given qualification requirements pursuant to the stipulations of Part four, Head VIII, Section 1 of the Act.
Offers of the contractors must not include such rewrites or corrections that could mislead the customer.
The customer requires that every offer includes at least the following documents:
- fully completed offer cover sheet structured pursuant to Appendix 3,
- contract proposal pursuant to Appendix 2,
- documents that demonstrate compliance with the given qualification requirements,
- signed statutory declaration on the given qualification pursuant to Appendix 4,
- other documents that the given contractor desires to submit.
Dodavatel, který podal nabídku v zadávacím řízení, nesmí být současně osobou, jejímž prostřednictvím jiný dodavatel v tomtéž zadávacím řízení prokazuje kvalifikaci. Součástí krycího listu nabídky bude prohlášení dodavatele, že není poddodavatelem, jehož prostřednictvím jiný dodavatel v tomtéž zadávacím řízení kvalifikaci prokazuje.
Pokud dodavatel podá více nabídek samostatně nebo společně s jinými dodavateli nebo podal nabídku a současně je osobou, jejímž prostřednictvím jiný účastník zadávacího řízení v tomtéž zadávacím řízení prokazuje kvalifikaci, zadavatel takového účastníka zadávacího řízení vyloučí.
Zadavatel požaduje, aby při společné nabídce více dodavatelů byl předložen písemný dokument podepsaný všemi dodavateli (například smlouva), z něhož bude vyplývat rozdělení odpovědnosti za plnění veřejné zakázky. Zadavatel vyžaduje, aby všichni dodavatelé podávající společnou nabídku nesli odpovědnost společně a nerozdílně.
The contractor who submits an offer for the given tender must not also be the person, through which another contractor demonstrates its qualification within the frame of the same tender proceedings. The offer cover sheet has to include a declaration of the contractor that it is not a subcontractor, through which another contractor demonstrates its qualification within the frame of the same tender proceedings.
Should a contractor submit multiple offers independently or jointly with other contractors, or should the contractor submit an offer and, at the same time, be the person, through which another participant of the tender proceedings demonstrates its qualification within the frame of the same tender proceedings, the customer will remove such contractor from participating in the tender proceedings.
The customer requires that all offers submitted jointly by multiple contractors include a written document signed by all the participating contractors (such as a contract), based on which individual responsibilities for the fulfillment of the public contract will be clear. The customer requires that all contractors who submit a joint offer have the same and joint responsibility.
Nabídku je možné podat pouze v elektronické podobě, a to prostřednictvím elektronického nástroje, přičemž tato musí být podána v souladu s požadavky stanovenými v § 107 zákona, s tím, že ustanovení § 107 odst. 1 o listinné podobě nabídky se nepoužije. Nabídku není možno podat prostřednictvím datové schránky.
Článek IX Hodnocení nabídek
Základním hodnotícím kritériem je ekonomická výhodnost nabídky dle § 114 zákona.
Zadavatel stanovuje následující kritérium hodnocení:
Celková nabídková cena v Kč bez DPH váhový faktor 100%.
Účastníci zadávacího řízení budou seřazeni podle výše celkové nabídkové ceny v Kč bez DPH.
Jako nejvýhodnější bude hodnocena nabídka s nejnižší nabídkovou cenou jako nejméně výhodná nabídka s nejvyšší nabídkovou cenou.
Submission of an offer:
Offers can be submitted only in an electronic form via an electronic instrument. Offers have to be submitted in compliance with the requirements specified in Section 107 of the Act, with the stipulation that the specifications included in Section 107, Paragraph 1 on the printed form of offers will not be used. Offers cannot be submitted via a data box.
Article IX Evaluation of the offers
The basic evaluation criterion is the economic expediency of the offer pursuant to Section 114 of the Act.
The customer determines the following evaluation criterion:
Total offer price in CZK, excluding VAT weight factor 100%.
The participants of the tender proceedings will be put in order based on the amount of the total offer price in CZK, excluding VAT.
The best offer should be the offer with the lowest offer price. The least convenient offer should be the offer with the highest price.

Ostatní sdělení zadavatele
Zadavatel je za účelem řádného zadání veřejné zakázky povinen zpracovávat osobní údaje, a to v případech, kdy to zákon zadavateli výslovně ukládá nebo umožňuje. Dále mohou být zadavatelem zpracovány také osobní údaje, jejichž zpracování zákon výslovně neukládá, ale jejichž zpracování je nezbytné pro splnění zákonné povinnosti zadavatele, tedy pro řádné zadání veřejné zakázky. Zadavatel při zpracování osobních údajů vždy postupuje v souladu s platnou právní úpravou.
Zadavatel nehradí účastníkům zadávacího řízení náklady vzniklé z účasti v řízení s výjimkou podmínky stanovené v § 40 odst. 4 zákona.
Účastník zadávacího řízení podáním nabídky uděluje zadavateli souhlas k ověření a prověření údajů uvedených v nabídce. Zadavatel si vyhrazuje právo ověřit informace obsažené v nabídce účastníka zadávacího řízení u třetích osob a účastník je povinen mu v tomto ohledu poskytnout veškerou potřebnou součinnost. Zadavatel vyloučí účastníka ze zadávacího řízení v případě, že účastník uvede ve své nabídce nepravdivé údaje.

Other notifications of the customer
In order to ensure a proper tender for the public contract in question, the customer is obliged to process personal data when the corresponding legal regulations explicitly require or allow it. Furthermore, the customer can also process personal data, processing of which is not explicitly prescribed by the law, however, processing of which is necessary for fulfilling the legal obligation of the customer, i.e. for properly conducting the tender for the public contract. When processing personal data, the customer always proceeds in compliance with the given valid legal regulation.
The customer does not reimburse the tender participants for their expenses incurred in relation to their participation in the tender, with the exception of the condition specified in Section 40, Paragraph 4 of the Xxx.Xx submitting their offers, the tender participants grant the customer the right to verify the data stated in their respective offers. The customer reserves the right to verify the information included in the offers of the tender participants with the help of third parties. From this perspective, the tender participants are obliged to provide the customer with all necessary cooperation. Should a tender participant state incorrect information in its offer, the customer will exclude the participant from the tender.

Zadavatel zpracoval tuto zadávací dokumentaci dle svých nejlepších znalostí a zkušeností z oblasti zadávání veřejných zakázek s cílem zajistit transparentní, nediskriminační, přiměřené a hospodárné zadání veřejné zakázky. Zadavatel i přes nejlepší péči nemůže vyloučit, že budoucí názor orgánu dohledu
na skutečnosti a procesy upravené v zadávací dokumentaci, může být odlišný od názoru zadavatele.
Zadavatel dále upozorňuje dodavatele na skutečnost, že zadávací dokumentace je souhrnem požadavků zadavatele a nikoliv konečným souhrnem veškerých požadavků vyplývajících z obecně závazných norem. Dodavatel se tak musí při zpracování své nabídky vždy řídit nejen požadavky obsaženými v zadávací dokumentaci, ale též ustanoveními příslušných obecně závazných norem.
Dodavatel je v průběhu celého zadávacího řízení povinen předložit veškeré dokumenty požadované v této zadávací dokumentaci, ve výzvě či dané zákonem.
Před uzavřením smlouvy zjistí zadavatel u vybraného dodavatele, je-li právnickou osobou, údaje o jeho skutečném majiteli podle § 122 zákona. Nebude-li zadavatel schopen zjistit údaje o skutečném majiteli vybraného dodavatele podle zákona upravujícího veřejné rejstříky fyzických a právnických osob, vyzve vybraného dodavatele:
The customer has prepared the contractual documentation based on its best knowledge and experience from the area of tenders for public contracts with the objective to ensure transparent, indiscriminatory, adequate and economical public contract tender proceedings. Despite exercising the best possible care, the customer cannot rule out that a future opinion of supervisory authorities with regard to the facts and processes addressed by the contractual documentation can differ from the opinion of the customer.
Furthermore, the customer informs the contractor about the fact that the contractual documentation represents a summary of the requirements of the customer and not a final list of all the requirements arising from the generally binding standards. When preparing its offer, the contractor thus has to always comply not only with the requirements included in the contractual documentation, but also with the stipulations of the corresponding, generally binding standards.
During the entire tender period, the contractor is obliged to submit all documents required in this contractual documentation, in the invitation or in the corresponding legal regulations.
Prior to concluding a contract, the customer determines if the selected contractor is a legal entity and finds out information about its actual owner pursuant to Section 122 of the Act. Should the customer not be able to find the information about the actual owner of the selected contractor pursuant to the act that addressed public registers of physical persons and legal entities, the customer will ask the contractor to:
a) ke sdělení identifikačních údajů všech osob, které jsou jeho skutečným majitelem, a
b) k předložení dokladů, z nichž vyplývá vztah všech osob podle písmene b) k dodavateli; těmito doklady jsou zejména
- výpis z obchodního rejstříku nebo jiné obdobné evidence,
- seznam akcionářů,
- rozhodnutí statutárního orgánu o vyplacení podílu na zisku,
- společenská smlouva, zakladatelská listina nebo stanovy.
Vybraný dodavatel bude rovněž vyzván k předložení originálů nebo ověřených kopií dokladů o jeho kvalifikaci, pokud je již zadavatel nemá k dispozici. K dokladům a listinám předloženým v jiném než českém jazyce nebo anglickém jazyce musí být připojen jejich překlad do českého jazyka nebo anglického jazyka.
a) provide identification data of all persons who are its real owners, and
b) to submit documents that demonstrate the corresponding relation of all the persons to the contractor pursuant to Letter a); these documents particularly include
- Excerpt from the Companies Register or another, analogous register,
- List of the shareholders,
- Decision of the statutory body on the payment of a profit share,
- Collective agreement, foundation charter or articles of incorporation.
The selected contractor will be also asked to provide the originals or certified copies of its qualification documents, provided the customer does not have them available. Documents provided in other than Czech or English language should be accompanied by their translation to the Czech or English language.

Pokud nebyla nabídka zadavateli doručena ve lhůtě nebo způsobem stanoveným v zadávací dokumentaci, nepovažuje se za podanou a v průběhu zadávacího řízení se k ní nepřihlíží.
Zpřístupnění nabídek proběhne dne 25. 04. 2019 v 9:00 hodin v sídle zadavatele, tj. Vysoká škola báňská – Technická univerzita Ostrava, 17. listopadu 15/2172, 708 00 Ostrava - Poruba, místnosti A1023.
Zpřístupnění nabídek je neveřejné.
Should a given offer not be delivered to the customer by the specified deadline or in the manner specified in the contractual documentation, the offer will not be considered submitted and will thus not be taken into account during the tender proceedings.
The offers will be made available on 25. 4. 2019 at 9:00 at the seat of the customer, i.e. VSB – Technical University of Ostrava, 17. listopadu 15/2172, 708 00 Ostrava - Poruba, room A1023.
The process of making the offers available is not public.
