Acceptable Use Guidelines has the meaning set forth in Section 3.1.

Cards include, but are not limited to, credit and debit cards, stored value cards, loyalty cards, electronic gift cards, authorised account or access numbers, paper certificates and credit account; Cardholder: the person or entity to whom a Card is issued or who is otherwise authorised to use a Card; Chargeback: a challenge to a payment that a Customer Cardholder files directly with his or her credit card issuer or company resulting in cancellation of a Transaction in respect of which the Customer has been paid or was due to be paid; Customer: the person, firm or company including its officers, employees and agents who purchases the Services from Upay as agreed from time to time; Customer Equipment: any equipment, hardware, computer, systems, cabling or facilities provided by the Customer and used directly or indirectly in the supply of the Services; Customer Information: data and any other materials (in whatever form) published or otherwise made available (directly or indirectly) by the Customer or on behalf of the Customer by using the Services or relating to the Services. Customer Information may include information about the Customer itself (including individual employees or representatives), or permitted users or clients of the Customer (or prospective clients) that may include personal data subject to laws or regulations; Document: includes, without limitation, in addition to any document in writing, any drawing, map, plan, diagram, design, picture or other image, tape, disk or other device or record embodying information in any form; Effective Date: the effective date stated upon the Order Form or if no effective date is stated on the Order Form, the date of Upay’s signature upon the Order Form following signature by the Customer, or the commencement of provision of Services if earlier; Fees: al...
