Aggregate Productive Capacity definition

Aggregate Productive Capacity or “APC” is a measurement intended to approximate the total of the productive capacities of the Mines of a Producer and shall be adjusted from time to time as provided for in this Agreement. However, because only certain changes in productive capacity qualify as provided herein for an adjustment of APC, it is acknowledged that the actual total of the Individual Productive Capacities of the Mines of a Producer, as calculated from time to time for purposes of this Agreement, may differ from the APC of the Producer, as calculated from time to time for purposes of this Agreement. The Aggregate Productive Capacities of the Producers as of the Effective Date are as follows: Agrium Inc. - 1,959,272 Product Tonnes per annum Mosaic Group - 10,129,953 Product Tonnes per annum Potash Corporation of Saskatchewan Inc. (“PCS”) - 11,724,393 Product Tonnes per annum For convenience, the Aggregate Productive Capacities of the Producers are also set forth in Schedule 1 appended to this Agreement, which schedule shall be modified and reconfirmed by each Producer by written agreement based upon such adjustments as may be required after audits conducted pursuant to and in accordance with Articles VI, VII or VIII of this Agreement. It is further acknowledged that the Aggregate Productive Capacity of a Producer, when such reference is to Mosaic Canada Crop Nutrition, LP, shall be understood to relate to the productive capacities of all of the Mines of the Mosaic Group, and that Canpotex shall at all times be entitled to treat the collective productive capacities of the Mines of the Mosaic Group as one APC for purposes hereof with one aggregate Basic Entitlement for purposes of this Agreement, and that it shall be the responsibility of Mosaic Canada Crop Nutrition, LP to ensure that the obligations set forth by or pursuant to this Agreement to deliver Potash to Canpotex consistent with such APC and Basic Entitlement are satisfied by the Mosaic Group;
Aggregate Productive Capacity means the aggregate annual productive capacity from time to time of the Mine or Mines, as the case may be, of each of the Producers, taking into account any Productive Capacity Change at the applicable time provided for in section 4.07 or section 5.04 hereof, expressed as a number of Product Tonnes per annum. Aggregate Productive Capacity means the aggregate Individual Productive Capacity from time to time of the Mine or Mines, as the case may be, of each of the Producers. It is acknowledged and agreed that as of July 1, 2002, the Aggregate Productive Capacity of the IMC Group as stated below and for all purposes hereof, including for determining the Basic Entitlement of the IMC Group, is 464,536 Product Tonnes per annum less than would be the case by aggregating the Individual Productive Capacities of the IMC Group Mines contained in subsection 1.02(m) hereof. This results from there having been completed in 2002 a Post-Expansion Audit Amount for the IMC Colonsay Mine which was 464,536 Product Tonnes per annum greater than the then current Individual Productive Capacity of that Mine, in connection with a proposed Major Expansion that did not result in an increase to the Aggregate Productive Capacity of the IMC Group. Accordingly, as of July 1, 2002, the Aggregate Productive Capacities of the Producers are as follows: Agrium — 1,741,000 Product Tonnes per annum IMC Group — 6,992,600 Product Tonnes per annum PCS — 10,333,500 Product Tonnes per annum

  • Where this Part V applies, the results of any Engineering Audit applicable to the Major Expansion shall not be used to determine, as a result of such Major Expansion, the Productive Capacity Change, the Producer’s Aggregate Productive Capacity or the Individual Productive Capacity of the applicable Mine, but rather, such matters shall be determined in accordance with this Part V.

  • Project Capacity means the AC capacity of the project at the generating terminal(s) and to be contracted with MSEDCL for supply from the Solar Power Project.

  • Available Capacity means the capacity from the Project, expressed in whole megawatts, that is available to generate Product. [For As-Available Product facilities only]

  • Idle capacity means the unused capacity of partially used facilities. It is the difference between: (a) that which a facility could achieve under 100 percent operating time on a one-shift basis less operating interruptions resulting from time lost for repairs, setups, unsatisfactory materials, and other normal delays; and (b) the extent to which the facility was actually used to meet demands during the accounting period. A multi-shift basis should be used if it can be shown that this amount of usage would normally be expected for the type of facility involved.

  • Maximum Capacity or ‘Pmax’ means the maximum continuous active power which a power-generating module can produce, less any demand associated solely with facilitating the operation of that power-generating module and not fed into the network as specified in the connection agreement or as agreed between the relevant system operator and the power-generating facility owner;

  • Excess Capacity means volume or capacity in a duct, conduit, or support structure other than a utility pole or anchor which can be used, pursuant to the orders and regulations of the Commission, for a pole attachment.

  • Available RP Capacity Amount means the amount of Restricted Payments that may be made at the time of determination pursuant to Sections 6.04(a)(ii)(D), (a)(vii) and (a)(x) minus the aggregate amount of the Available RP Capacity Amount utilized by the Borrower or any Restricted Subsidiary to (a) make Investments pursuant to Section 6.06(q)(ii), (b) make Restricted Debt Payments pursuant to Section 6.04(b)(iv)(B) or (c) incur Indebtedness pursuant to Section 6.01(ll).

  • Contract Capacity has the meaning set forth in Section 3.1(f).

  • Nominal Capacity means the volume indicated by the manufacturer that represents the maximum recommended filling level.

  • RA Capacity means the maximum megawatt amount that the CAISO recognizes from a Project that qualifies for Buyer’s Resource Adequacy Requirements and is associated with the Project’s Capacity Attributes.

  • Storage Capacity means any combination of space, injectability and deliverability.

  • Potential electrical output capacity means, with regard to a unit, 33 per- cent of the maximum design heat input of the unit.

  • New Capacity means a new Generator, a substantial addition to the capacity of an existing Generator, or the reactivation of all or a portion of a Generator that has been out of service for five years or more that commences commercial service after the effective date of this definition. For purposes of Section 23.4.5 of this Attachment H, “Offer Floor” for a Mitigated Capacity Zone Installed Capacity Supplier that is not a Special Case Resource shall mean the lesser of (i) a numerical value equal to 75% of the Mitigation Net CONE translated into a seasonally adjusted monthly UCAP value (“Mitigation Net CONE Offer Floor”), or (ii) the numerical value that is the first year value of the Unit Net CONE determined as specified in Section 23.4.5.7, translated into a seasonally adjusted monthly UCAP value using an appropriate class outage rate, (“Unit Net CONE Offer Floor”). The Offer Floor for a Mitigated Capacity Zone Installed Capacity Supplier that is a Special Case Resource shall mean a numerical value determined as specified in Section 23.4.5.7.5. The Offer Floor for Additional CRIS MW shall mean a numerical value determined as specified in Section 23.4.5.7.6. For the purposes of Section 23.4.5 of this Attachment H, “Non-Qualifying Entry Sponsors” shall mean a Transmission Owner, Public Power Entity, or any other entity with a Transmission District in the NYCA, or an agency or instrumentality of New York State or a political subdivision thereof.

  • Nameplate capacity means the maximum electrical generating output (in MWe) that a generator can sustain over a specified period of time when not restricted by seasonal or other deratings as measured in accordance with the United States Department of Energy standards.

  • Generation Capacity Resource shall have the meaning specified in the Reliability Assurance Agreement. Generation Interconnection Customer:

  • Design capacity means the volume of a containment feature at a discharging facility that accommodates all permitted flows and meets all Aquifer Protection Permit conditions, including allowances for appropriate peaking and safety factors to ensure sustained, reliable operation.

  • Committed Capacity means that portion of the Capacity that is required to meet the Capacity Entitlements of Access Holders;

  • Planned Financed Generation Capacity Resource means a Planned Generation Capacity Resource that, prior to August 7, 2015, has an effective Interconnection Service Agreement and has submitted to the Office of the Interconnection the appropriate certification attesting achievement of Financial Close.

  • System Capacity means the operational capacity of the System at any applicable point in time.

  • Interruptible Capacity means capacity that may be interrupted by the Operator at any time in order to fulfil shippers’ nominations under a firm capacity reservation.

  • Throughput means the measure of production, or factor related to production, used to determine the relationship between the amount of energy used by the target unit and the levels of activity of the target unit, as set out in Schedule 6 to an underlying agreement; “the Tribunal” means the First-tier Tribunal established under the Xxxxxxxx Xxxxxx xxx Xxxxxxxxxxx Xxx 00000;

  • Contracted Capacity means the capacity (in MW AC) contracted with MSEDCL for supply by the successful bidder at the Delivery Point from the Solar Power Project.

  • Technical Capacity means the maximum firm capacity that the transmission system operator can offer to the network users, taking account of system integrity and the operational requirements of the transmission network;

  • Licensed capacity means the number of children the Department has determined the day care home can care for at any one time in addition to any children living in the home who are under the age of 12 years. Children age 12 and over on the premises are not considered in determining licensed capacity.

  • Base Capacity Resource Price Decrement means, for the 2018/2019 and 2019/2020 Delivery Years, a difference between the clearing price for Base Capacity Resources and the clearing price for Capacity Performance Resources, representing the cost to procure additional Capacity Performance Resources out of merit order when the Base Capacity Resource Constraint is binding.

  • Additional Capacity means, in relation to the Network, the capability of the Network to carry additional task by an enhancement or improvement of the infrastructure forming part of the Network or Associated Facilities;

  • Rated Capacity means the Average Daily Flow for which the Works are approved to handle;
