Alternative Source definition

Alternative Source shall have the meaning set forth therefor in the definition of Eurodollar Rate.
Alternative Source has the meaning set forth in Section 9(a) hereof.
Alternative Source has the meaning given to such term in Section 4.8.1.

  • In the event Seller elects to furnish Substitute Coal from an Alternative Source as provided in Section 6, Buyer and Seller shall mutually agree to an alternative place to tender the delivery of such Substitute Coal (and such point shall be the “Point of Delivery” therefore), and to any reasonable arrangements needed to accommodate the loading of such Substitute Coal into Buyer’s Transportation Equipment.

  • Prior to using an Alternative Source, Seller shall obtain and provide to Buyer evidence that demonstrates to the reasonable satisfaction of Buyer that such Alternative Source produces Coal having the average quality characteristics described in Section 5.1, or otherwise as approved by Buyer, which approval shall not be unreasonably withheld.

  • Such Alternative Source shall be the primary source for the final assembled packaged and labelled Device.

  • In any event, the components for the Device that are proprietary to Aerogen (Device Proprietary Components) will still be supplied by Aerogen to Dance and/or to the Alternative Source at Dance’s expense and according to the pricing, ordering and payment provisions of this Addendum.

More Definitions of Alternative Source

Alternative Source means, with respect to any matter that is the subject of a claim or threatened claim under the Xxxxxxxx Guaranty, any of the following: (v) the letters of credit or bonds referred to in Section 4.8(e) (iii) and (iv) above are in amounts sufficient to pay the costs of addressing such matter and Purchaser is diligently addressing such matter to the satisfaction of the State; (w) Purchaser has sufficient financial and other resources to address such matter and does diligently address such matter to the satisfaction of the State; (x) any insurer which has issued an insurance policy with sufficient coverage available to pay the costs of addressing such matter has confirmed that such matter is covered by such insurance and Purchaser (or such insurer) is diligently addressing such matter to the satisfaction of the State; (y) the State has confirmed that the costs of addressing such matter will be paid out of the closure or long-term care funds maintained for the Xxxxxxxx Facility and not pursuant to the Xxxxxxxx Guaranty; or (z) the State has confirmed that it will not seek to recover such costs under the Xxxxxxxx Guaranty.
Alternative Source shall have the meaning given in Section 6.1.
Alternative Source means a source of water used by a Party to meet a Parcel’s annual Consumptive Use in addition to or instead of available Sustainable Yield of Native Groundwater or APA, as such is calculated pursuant to Section 1.8. An Alternative Source may include water available under a surface water right or contract, a recharge water account, or other source as allowed pursuant to Section 1.8.4.
