The Antenna Facilities shall remain the exclusive property of Tenant and shall not be considered fixtures.
If any tower or other support structure for Tenant’s Antenna Facilities is owned by Landlord, Landlord acknowledges that Landlord shall be responsible for compliance with all marking and lighting requirements of the Federal Aviation Administration and the FCC.
Except in the event of an emergency, Tenant covenants to repair, maintain and remove its Antenna Facilities during normal business hours.
Such installation of Tenant’s Antenna Facilities, including the aesthetic compatibility of such Antenna Facilities with the design and appearance of the Building and the height and weight of the Antenna Facilities, shall be subject to Landlord’s approval.
As more particularly set forth in Exhibit E attached hereto, Tenant must pay for the maintenance and repair of the antenna, satellite dish and/or other equipment placed upon such licensed portion of the Building’s rooftop (collectively, “Antenna Facilities”), as well as all utilities used to operate such Antenna Facilities.
The installation of Tenant’s Antenna Facilities shall be engineered by Landlord’s engineers at Tenant’s sole cost and expense.
Landlord hereby waives any and all lien rights it may have concerning the Antenna Facilities.
If Tenant’s Antenna Facilities are mounted on the Structure they shall, at all times, be painted, at Tenant’s expense, the same color as the Structure.
Upon the relocation of the Antenna Facilities, all references in this Agreement to the Premises shall be deemed to be references to the New Location.
Licensee shall pay annually an amount equal to any increase in real estate taxes, if any, directly attributable to the presence or installation of Licensee’s Antenna Facilities, only for so long as this License remains in effect.
