BAM means Brookfield Asset Management Inc., a corporation existing under the Laws of the Province of Ontario, and is deemed to refer to all successors, including, without limitation, by operation of Law;

  • Anything in this Indenture to the contrary notwithstanding, upon the occurrence and continuance of a default or an event of default with respect to payment of the Bonds, BAM shall be deemed to be the sole holder of the Bonds for all purposes and shall be entitled to control and direct the enforcement of all rights and remedies granted to the Holders for the benefit of such Holders under this Indenture.
