Carmel Trust means The Carmel Trust, a trust governed by the laws of Canada, so long as the beneficiaries of such Trust are the named beneficiaries of the Trust on the Closing Date or the beneficiaries that may be designated as such pursuant to the terms of the agreement pursuant to which the Trust was established, as such agreement is in effect as of the Closing Date.

  • First trust means a trust over which an authorized fiduciary may exercise the decanting power.

  • Owner Trust means the trust created by this Agreement.

A power holder's lack of capacity to exercise a power of revocation negates the power of revocation unless an agent of the power holder under a durable power of attorney, a conservator of the power holder, or a plenary guardian of the power holder is serving and the agent, conservator, or guardian is authorized to exercise the power of revocation.

  • Trust means the arrangement through which the property of one person is made over or bequeathed to a trustee to administer such property for the benefit of another person; and

  • unit trust means any trust established for the purpose, or having the effect, of providing facilities for the participation by persons as beneficiaries under a trust, in profits or income arising from the acquisition, holding, management or disposal of securities or any other property.

  • PFPC Trust means PFPC Trust Company or a subsidiary or affiliate of PFPC Trust Company.

  • Business Trust Act means Chapter 38 of Title 12 of the Delaware Code, 12 Del. Code Section 3801 et seq., as it may be amended from time to time, or any successor legislation.

  • Original Trust Agreement has the meaning specified in the recitals to this Trust Agreement.

  • Initial Trust Agreement shall have the meaning assigned to such term in Section 2.12 of the Trust Agreement.
