Closing Shift(s) definition

Closing Shift(s) means a shift worked at Best Buy by a Class Member where the Class Member’s timecard punch-in or punch-out occurs after the last customer transaction of that calendar day. For purposes of this Settlement, the last customer transaction time was truncated to the nearest hour and the most frequent hour occurrence for all retail stores in the State of New York was used to determine Closing Shift.

Examples of Closing Shift(s) in a sentence

  • If a Former Employee Participating Claimant has worked fewer than five (5) Closing Shifts, he/she shall be treated as if he/she worked five (5) Closing Shifts for purposes of this Stipulation.

  • If a Current Employee Participating Claimant has worked fewer than five (5) Closing Shifts, he/she shall be treated as if he/she worked five (5) Closing Shifts for purposes of this Stipulation.

  • Generally speaking, X is a Settlement Class 19 Member entitlement calculated in accordance with Section 7.6.3 above and Y is an Aggrieved Closing Shifts Worked Settlement Award Estimated Employees In Group Avg.

  • In the event that this process would result in a cumulative total amount greater than $241,757, each Current Employee Participating Claimant shall then share in the fund’s monies on a pro rata basis accounting for the number of Closing Shifts each Current Employee Participating Claimant worked during the Class Period.

  • Defendant will also report to the Settlement 5 Administrator the number of Closing Shifts worked by each Class Member and the number of pay 6 periods worked by each Aggrieved Employee.

  • Each Settlement Class 2 Member’s share of the Net Settlement Amount will reflect the number of Closing Shifts credited to the 3 Settlement Class Member, in relation to the total number of Closing Shifts worked by all Settlement 4 Class Members during the Settlement Period.

  • For purposes 9 of Class Notice, amounts will be calculated provisionally on the basis of the number of Closing Shifts 10 attributed to each Class Member, in accordance with Section 7 of this Agreement.

  • Defendant’s time records regarding the number of 19 Closing Shifts shall control for purposes of calculation unless the Class Member submits contrary 20 evidence to the Settlement Administrator that the Settlement Administrator finds to be persuasive.

  • With respect to calculating Settlement Class Payments, each Former Employee will be 27 credited with 25 additional Closing Shifts, to account for the additional Section 203 claim available to 28 Former Employees.

  • In the event that this process would result in a cumulative total amount greater than $350,809, each Former Employee Participating Claimant shall then share in the fund’s monies on a pro rata basis accounting for the number of Closing Shifts each Former Employee Participating Claimant worked during the Class Period.

Related to Closing Shift(s)

  • Closing Stock Price means the Stock Price as of the last day of any Performance Measurement Period.

  • Closing Shares shall have the meaning ascribed to such term in Section 2.1(a)(i).

  • Closing Cash Amount means the amount of cash and cash equivalents held by the Company and the Company’s Subsidiaries, net of outstanding checks, as of the close of business on the day immediately preceding the Closing Date.

  • Closing Cash means the aggregate amount of all Cash and Cash Equivalents of the Group Companies as of the Adjustment Time.

  • Estimated Closing Working Capital has the meaning set forth in Section 2.04(a)(ii).
