CMS Basic Rebate definition

CMS Basic Rebate means, with respect to the Covered Product(s), the quarterly payment by the Manufacturer pursuant to the Manufacturer’s CMS Agreement, made in accordance with Section 1927(c)(1) or Section 1927(c)(3) of the Social Security Act [42 USC 1396r-8(c)(1) and 42 USC 1396r-8(c)(3)].

  • The interest rate shall be determined as specified under federal guidelines for rebates under the CMS Basic Rebate.
