For the avoidance of doubt, all of the restrictions for the Products in the Agreement also apply to Commercial Components.
Commercial Components are also subject to some additional requirements as set forth below.
You may not install, access, configure or use any Commercial Components (including any APIs, tools, databases or other aspects any Commercial Components) separately or independently of the rest of the Product, whether for production, technical support or any other purposes, or otherwise attempt to gain direct access to any portions of the Commercial Components, or permit anyone else (including your customers) to do any of these things.
For the avoidance of doubt, (x) no rights are granted to ▇▇▇▇ under the NETGEAR Licensed Patents outside the ▇▇▇▇ Licensed Field, and (y) no rights are granted to make or have made any Commercial Components.
Accordingly, notwithstanding any other terms of the Agreement, you may not modify any Commercial Components.
The Company will accept the FAR 52.244-6, Subcontracts for Commercial Items clause, and DFARS 252.244-7000, Subcontracts for Commercial Items and Commercial Components (DoD Contracts) if required by the Prime Contract and if applicable.
If required by law, the Federal Acquisition Regulation (“FAR”) clause 52.244-6 (Subcontracts for Commercial Items) and Defense Federal Acquisition Regulation Supplement (“DFARS”) clause 252.244-7000 (Subcontracts for Commercial Items and Commercial Components (DoD Contracts)) are incorporated into this Agreement by reference.
If minor modifications (as described in FAR 2.101 Commercial Items (3) (ii) ) are made to the items to qualify them or bring them up to Government specifications, these items still meet the standard of Commercial Item or Commercial Components.
In addition, Supplier will comply with all terms of 48 C.F.R. § 52.244-6 (Subcontracts for Commercial Items and Commercial Components) (including the requirement of including this provision in subcontracts awarded under this contract), 15 U.S.C. § 637 (d) (2) and (3) (Utilization of Small Business Concerns), and such provision is hereby incorporated into this Agreement as if fully set forth herein.
Therefore, this Agreement incorporates by reference, and Seller will comply with, the following provisions of Title 48 of the Code of Federal Regulations: 52.219-8, Utilization of Small Business Concerns; 52.222-26, Equal Opportunity; 52.222-35, Affirmative Action for Special Disabled and Vietnam Era Veterans; 52.222-36, Affirmative Action for Handicapped Workers; and 52.244-6, Subcontracts for Commercial Items and Commercial Components.
