Sectional Title Bodies Corporate are unique borrowers whose income (levies) are protected and secured by legislation – Sectional Titles Schemes Management Act 8 of 2011 (“the STSMA”) and the Sectional Titles Act 95 of 1986 (“the STA”) and the Community Schemes Ombud Service Act 9 of 2011 (“the CSOSA”).
This is an application for dispute resolution in terms of section 38 of the Community Schemes Ombud Service Act 9 of 2011 (“the CSOS Act”’).

The notice in regard to the right of appeal referred to in section 54(1)(d) of the Act must read as follows: “In terms of section 57 of the Community Schemes Ombud Service Act, 2011 (Act No. 9 of 2011) a person who is dissatisfied with an adjudicator’s order is entitled to appeal to the High Court, but only on a question of law.
This Act is called the Community Schemes Ombud Service Act, 2011, and comes into operation on a date to be determined by the President by proclamation in the Gazette.
