Examples of Compounded Reference Rate in a sentence
Section 2255 of Title 28 of the United States Code provides that a federal prisoner serving a court-imposed sentence “may move the court which imposed the sentence to vacate, set aside or correct the sentence.” 28U.S.C. § 2255(a).
Notwithstanding Sections 2.06(h)(i)-(iii) above, if, as at the relevant Quotation Day, a Reference Rate Non-Utilisation Event has occurred and is continuing, the applicable Reference Rate shall be the Compounded Reference Rate and interest on that Reference Rate Loan (or any part thereof) shall be determined in accordance with Section 2.06(i).
If clause 3.3 above applies but it is not possible to calculate the Interpolated Historic Term SOFR for the Interest Period of the Floating Rate Loan then the Reference Rate shall not apply for the Floating Rate Loan or that part of the Floating Rate Loan (as applicable) and instead interest shall be determined by reference to the Compounded Reference Rate and the provisions of clause 4 will apply in respect of the Floating Rate Loan or the relevant part of the Floating Rate Loan (as applicable).
Accordingly, on and from the Rate Switch Date, the Loan will switch from a USD-LIBOR Loan to a Compounded Rate Loan and interest will be calculated by reference to the Compounded Reference Rate as further set out in section 3 (New interest provisions) below.
Under the previous order, the President will be immediately notified of the Senate’s consent to the resolution of ratifica- tion.
