Examples of Data Protection Losses in a sentence
The Supplier shall indemnify and keep indemnified the Client in respect of all Data Protection Losses suffered or incurred by, awarded against or agreed to be paid by, the Client or any member of Client’s Group arising from or in connection with any breach by the Supplier of any of its obligations under Clauses 18.1 to 18.6 (inclusive).
To the maximum extent permitted by law, Data Processor shall not be liable for any consequential or indirect Data Protection Losses contributed to or caused by any breach of this Addendum or the Agreement by the Data Controller or otherwise caused by the acts or omissions of the Data Controller.
For greater certainty, CWC shall be exempt from liability for Data Protection Losses under this Clause 12.1 if it proves that it is not in any way responsible for the event giving rise to the damage.
This limitation shall not apply in cases of wilful intent, gross negligence or lack of due diligence by CWC parties or to any Data Protection Losses that arise as a result of CWC not complying with Data Protection Law specifically directed to Processors or where CWC has acted outside of or contrary to your lawful Processing Instructions.
