Defective Services definition

Defective Services means Services of an inferior quality or which are otherwise inconsistent with this Contract.
Defective Services means services or the results of any services which are not in conformity with the supply contract, are of inferior quality or workmanship or are otherwise unsatisfactory;
Defective Services means Services not properly performed in accordance with the Agreement and/or applicable Service Levels.

Examples of Defective Services in a sentence

  • In the event that the Company identifies any of the Services as being defective, deficient or otherwise failing to meet the requirements and standards set out in this Agreement (“Defective Services”), the Company may within [24] months of the completion of the Services instruct the Contractor to correct or re-perform such Defective Services.

  • Contractor acknowledges that Contractor’s failure to re-perform Defective Services will cause the Court to incur administrative costs associated with remedying such failure, and that such costs could be difficult to estimate in advance or to quantify in retrospect.

  • Accordingly, the parties agree that, as liquidated damages (and not a penalty) for each failure of Contractor to re-perform Defective Services in accordance with Section 7.2 (“Re-Performance of Defective Services”), the Court may deduct a $125 handling fee from any amount payable to Contractor.

  • If Client decides to return the Defective Products or reject the Defective Services, then Supplier shall pay Client the costs incurred in returning the Defective Products or rejecting the Defective Services and, at Client’s option, (a) Supplier shall send replacements of the Products deemed Defective Products without any additional cost or re-render the Services; or (b) Supplier shall deliver to Client a credit note for the value of the Defective Products or Defective Services.

  • In the event that Signify decides, in its sole discretion, that a claim under warranty is valid, Signify shall, within a reasonable time, at its own option, repair or offer replacement products for Defective Products, or remedy or supplement any Defective Services.

Defective Services means Services supplied to NSW RFS that do not conform to the Specifications or a Purchase Order, Interim Approval Reference or a Dispatch, breach the warranties in clause 7.1, Part C, or are damaged or otherwise defective. Dispatch means an order for an operational task placed in accordance with clause 4.2, Part C which sets out the details of the Tasks to be performed by the Supplier and incorporates the terms of this Deed. Emergency for the purpose of this Deed means an Incident where:
Defective Services means Services that are defective in performance;
Defective Services means Services that fail to comply with the relevant Specifications, are not fit for purpose, defective, incomplete or are otherwise defective in the reasonable opinion of Perfection.
Defective Services means goods and services, including materials and equipment used or provided by the Contractor in the performance of the Contract, which are, in Mackenzie County’s opinion, unsatisfactory, faulty or deficient, or do not conform to the Contract Documents.
